SAN FRANCISCO, Calif., Dec. 2, 2010 /Christian Newswire/ -- On December 6, 2010, oral arguments will commence in the ongoing Proposition 8 case, Perry v. Schwarzenegger, at the Ninth Circuit Court of Appeals in San Francisco, CA. This pivotal turn comes after federal judge Vaughn Walker overturned the California voter-backed Proposition 8, which limited marriage to one man and one woman, and denied the County of Imperial the right to intervene in defense of the proposition.

Robert Tyler, General Counsel, and Jennifer Monk, Associate General Counsel, of Advocates for Faith and Freedom, filed an appeal to the Ninth Circuit (Case No. 10-16751) on behalf of the County of Imperial to defend California's approval of Prop 8. The official proponents of Proposition 8 also filed an appeal (Case No. 10-16696) and both appeals will be argued concurrently on December 6 before a panel of three federal judges. The County, through Advocates for Faith and Freedom, will argue in defense of Proposition 8 and assert why it is imperative for this case to be decided by the Courts of Appeal.

Robert Tyler stated, "California's democratic system and the institution of marriage should not hinge on the decision of one federal judge. This is why the County of Imperial has sought to intervene -- to ensure that this case is reviewed in the courts of appeal."

Ms. Monk stated, "The County's ability to intervene in this case will ultimately decide whether the refusal of California state officials to defend a valid constitutional amendment will result in the redefinition of marriage by a single federal district court judge."

Both Mr. Tyler and Ms. Monk are available for comment in San Francisco on Sunday, December 5, and Monday, December 6, on the following topics:

  • The law and policy defending the traditional definition of marriage

  • The procedural and legal standing of this case

  • The possibility of this case reaching the U.S. Supreme Court

In addition to availability before oral arguments, Mr. Tyler and Ms. Monk will speak at a press conference immediately following the hearing at:

The Ninth Circuit Court of Appeals
95 7th Street
San Francisco, CA 94103
