TELLICO PLAINS, Tenn., June 8 /Christian Newswire/ -- On June 1, 2010 at 10:30 am Scott Morgan was released after spending 26 days incarcerated in jail after overpaying his child support. See part 1 www.christiannewswire.com/news/9361614013.html

Family, friends and members of the church where Mr. Morgan attends were present during the court hearing.

The hearing began at 10:15 am with Judge J. Michael Sharp announcing that he had read all Mr. Morgan's filings. With his son beside him, Mr. Morgan began by reading from a motion that he had filed to the court explaining that attorney Alliman's motion to the court lacked foundation and his former counsel Matthew Rodgers was ineffective as counsel by misrepresenting his wishes. Mr. Morgan continued by pointing out the intentional errors that attorney Alliman had entered into the court records, deceiving the court citing documents and court records of that evidence. Judge Sharp acknowledged receiving those documents, records and evidence. Evidence, which clearly showed Mr. Morgan to have overpaid in his child support.

With just his client and his client's mother, ACLU affiliate Attorney Peter Alliman responded by asking Judge Sharp to honor the appeals court decision and enforce the judgment even thought evidence presented to the court by Mr. Morgan clearly contradicted the appeals court decision. Judge Sharp announced he was going to enforce the appeals court decision. Mr. Morgan reminded Judge Sharp where he had ruled unfairly and wrongly against him in a past case defrauding him out of thousands of dollars of labor and materials. The subject matter was quickly changed.

Judge Sharp responded by stating he would be releasing Mr. Morgan, however he would have to pay $16,194.46 in the next 30 days or his property would be sold. "The judge released me with the threat that if I do not pay, he will sell my property. He only released me to allow me to get the money I don't owe," states Mr. Morgan.
