Ninth Circuit to Hear Argument on Counseling Restrictions Today

SAN FRANCISCO, Calif., June 22, 2016 /Christian Newswire/ -- Pacific Justice Institute is taking the next major step in challenging a law that restricts the constitutional rights of mental health providers and their clients, including ordained clergy and their parishioners.  The next major step in the litigation takes place today and members of the media are welcome to attend.

Pacific Justice Institute represents plaintiffs prohibited by SB 1172 from giving counsel to minors struggling with same-sex attractions and gender identity.  SB 1172, signed into law by Governor Jerry Brown in September 2012, restricts mental health professionals from using "change therapy" as an option for helping minors.  In December 2012, the United States District Court sided with Pacific Justice Institute by granting a preliminary injunction against SB 1172.  However, the Ninth Circuit reversed that injunction in August 2013.  At that time, the Ninth Circuit considered only these plaintiffs' free speech claims. The court will now consider religious freedom and privacy implications of the law.
