CBS (WUSA) Defies FCC Order, Refuses to Run TV Ads of Terry for President

Terry to request FCC revoke WUSA broadcast license, in accordance with law -- See Law Below

The FCC must vindicate its authority, and bring severe sanctions against WUSA. Otherwise, it tells rich and powerful stations that they can subvert free and open elections, and flaunt the law, with no fear of punishment

WASHINGTON, Nov. 2, 2012 /Christian Newswire/ -- On October 31, the FCC released a landmark decision regarding WUSA (CBS Affiliate, Washington DC) ruling that they were legally obligated to run Terry for President TV ads. (Link to Ruling below)

CBS attorneys -- Covington and Burling -- have told Terry for President that they will NOT run the ads. Under law, this constitutes a "repeated and willful failure" to obey FCC rules regarding reasonable access for Federal Candidates.

Mr. Terry will request that, in accordance with the law, their broadcast license be revoked. (See Law Below)

Mr. Terry states:

    "CBS is betting that the FCC will only issue a letter of reprimand, or perhaps fine them $9,000. This is 'chump change' to CBS. For example, one 30 second commercial during Face the Nation costs $30,000. They can pay a fine with one commercial, and laugh that they flaunted the law.
     
    "If the FCC does not revoke their license, they will give permission to all rich and powerful station owners to defy the law, and to muzzle all candidates, political parties, and political messages that they do not agree with.
     
    "Moreover, this could pave the way for severe upheaval, and God forbid, even worse. We have all agreed to the peaceful transition of power, based on free and open elections. We don't imprison, or torture, or exile, or kill people to change the reigns of government. We have a 'peaceful revolution' at the ballot box. But if the rich and powerful can determine which candidates and messages get heard -- and which ones get silenced -- then we no longer have free and open elections. We see the fruit of such policies in Egypt, Libya, Syria, etc. The long-term effects of the precedent being set by CBS' defiance of the law are chilling. We hope the FCC sees the danger of NOT revoking their license."

The law states:

Section 312 [47 U.S.C. §312] Administrative sanctions.

(a)    The Commission may revoke any station license or construction permit -- (7)  for willful or repeated failure to allow reasonable access to or to permit purchase of reasonable amounts of time for the use of a broadcasting station, other than a non-commercial educational broadcast station, by a legally qualified candidate for Federal elective office on behalf of his candidacy.

(f)    For purposes of this section:

(1)    The term "willful," when used with reference to the commission or omission of any act, means the conscious and deliberate commission or omission of such act, irrespective of any intent to violate any provision of this Act or any rule or regulation of the Commission authorized by this Act or by a treaty ratified by the United States.

(2)    The term "repeated," when used with reference to the commission or omission of any act, means the commission or omission of such act more than once or, if such commission or omission is continuous, for more than one day.

Note: The Covington and Burling law firm is a maniacal defender of abortion; on their web site they boast that their attorneys DEFENDED partial birth abortion.
