BIRMINGHAM, Ala., Sept. 30, 2013 /Christian Newswire/ -- LLDF Files Brief Urging Court to Keep Banned Abortionist's Clinic Closed Last week, Life Legal Defense Foundation countered illegal abortionist Bruce Norman's bid to continue performing abortions at the unlicensed New Woman, All Women abortion clinic in Birmingham, Alabama. The clinic, permanently closed by a Jefferson County Circuit Court injunction, has been the scene of ongoing controversy due to its continued operation by Norman and owner Diane Derzis. Life Legal Defense Foundation's "friends of the court" brief opposes Norman's request for reconsideration in the matter of his ban on performing abortions.
 
Norman was practicing at the Birmingham facility shut down by the Alabama Department of Public Health due to ongoing health hazards and violation of state laws. Defendant Bruce Norman's motion for reconsideration is set for hearing Tuesday, October 1st, at 8:30 am, before Jefferson County Circuit Court Judge Joseph Boohaker.
 
The Life Legal Defense Foundation brief argues Norman's:
 
·         Unsworn and unsupported statements, as submitted via his attorney, are not evidence and are in direct contradiction to the abortionist's statements at trial.
 
·         Attempt to submit altered testimony after the trial is not permissible and is not proper grounds to alter the court's initial order.
 
·         Agreement to be in voluntary compliance with the law is not a proper basis for modification of a previously issued order.
 
"Simply agreeing to follow the law does not alter the fact that the law was violated in the first place," stated Attorney Allison Aranda, Senior Staff Counsel for Life Legal Defense Foundation. She explained, "Such an argument would be comparable to a person committing a battery, being tried and convicted of battery, and then asking the judge to overturn his conviction because he promises not to do it again. There simply is no basis in law for this type of post-judgment repentance."
